Estate Planning

At Johnson & Perkins, PLLC we work with you in planning your estates and preparing your wills. We ask you to complete a very thorough will questionnaire in order to draft your will in a timely manner. This questionnaire not only helps us draft your will, but also causes you to make some very critical decisions regarding your estate. At Johnson & Perkins, we have found that the best way to serve our clients is by offering a will packet. Our simple will packet includes a will, Statutory Power of Attorney, Medical Power of Attorney, and a Physician’s Directive. Upon request and for no additional fee we will also draft a Disposition Concerning Remains. We maintain a network of professionals including financial advisors, certified public accountants, and bankers in an effort to fulfill all of your estate needs.

Probate

After the death of a loved one, one of the most painful realizations you will face is probating their estate. The state of Texas gives you four years from the date of death to file for probate. Regardless of whether the deceased left a will…regardless of the size of the estate…at least consult with Johnson & Perkins, PLLC. In order to legally transfer property of the deceased, you must file for probate. If your relative died without a will you will go through a process called intestate secession. During intestate secession you and your relatives will receive probate assets of the decedent according to the Texas Probate Code. We also have experience with Small Estate Affidavit in the event the estate has less that $50,000 in probate assets. In some cases the will is simply needed to convey title of real property the will can be simply probated as a Muniment of Title. Additionally, we have held our clients’ hand through the complications of independent and dependent administration. We are here to help ease the pain of what can be an arduous process.

Probate Litigation

At Johnson & Perkins, PLLC we competently represent our clients in contested probate matters. Unfortunately, not all probate matters are as simple as probating your relatives Last Will and Testament. In these instances we vigorously represent our client’s interests before the Court. Probate litigation is not a commonly practiced area of law nor is it an easy one, it is however a necessary one. We are establishing a good reputation with the Probate Courts in Harris and Fort Bend counties. Our probate litigation practice has also extended into Brazoria and Wharton County. We have fought battles for heirs and potential heirs in the form will contests and cases where the biological relationship is in question.
